අපගේ මුදලින් නඩත්තු වෙන දාමරිකයින් එලවා දමන්නේ කෙසේද?

නීතියෙන් දිය හැකි උපරිම දඬුවම මරණීය දණ්ඩනයයි. එයත් මේවන විට බොහෝ රටවල නීති පද්ධතියෙන් ඉවත් කර අවසානය. වරද කරුවෙකු ලෙස ඔප්පු වෙන තෙක් දඬුවම් කිරීමද වරදකි. ආරක්ෂක හමුදාවට හෝ පොලිසියට කෙනෙකුට දඬුවම් දිය නොහැක. කිසි ලෙසකවත් පහරක් වත් ගැසීම නීතියට අනුකුල නොවේ.
එහෙත් පසුගිය තෙමස තුල පොලිසියේ නිලධාරින්, ආරක්ෂක හමුදාවේ නිලධාරීන් සහ රාජ්‍ය පාක්ෂික මැරයින් විසින් අහිංසක කිසිඳු අවියක් නොදැරූ ජනතාවට පහර දී ඇති බව අප සමාජ මාධ්‍ය ජාලා හරහා දුටුවෙමු.
දැන් මෙයට හේතුව කුමක්දැයි අප විමසා බැලිය යුතුය. රටේ පාලන තන්ත්‍රය, රාජ්‍ය ත්‍රස්තවාදීන්ගෙන් පෝෂිත වූ කණ්ඩායමකි. ආරක්ෂක හමුදාවේ සහ පොලිසියේ මෙහෙයුම් කටයුතු කරන්නේ ද පවතින ආණ්ඩුවේ හෙන්චයියන්ය. මේ හෙන්චය්යියන් ඇතුළු මැති ඇමති වරුන් සියල්ල යැපෙන්නේ කාගේ මුදලින්ද යන වග අප හොඳින් සිහිපත් කලයුතු කාරණයකි. දිනෙන් දින මිල ඉහල යන විදුලිය, ජලය, ගෑස්, ඉන්ධන ඇතුළු අප එදිනෙදා භාවිතා කරන සෑම භාණ්ඩයකින්ම රජය අය කරගන්නා ලබන බද්ද මේ රාජ්‍ය සේවකයින්ගේ වැටුප් ලෙස අප සියලුදෙනාම අඩු වැඩි වශයෙන් ගෙවන්නෝය. බොහෝ විට ආරක්ෂක භටයින්ගෙන්, පොලිසියෙන් සහ රාජ්‍ය ත්‍රස්තයින්ගෙන් පහර කෑ පුද්ගලයින් අඩු වැඩි තරමින් මේ පහර දුන් පුද්ගලයාගේ වැටුපට දායක වී ඇතිබව අප මතක තබා ගත යුතුව ඇත.
එසේ නම් අප අපගේ මුදලින් මෙවන් දාමරිකයින් නඩත්තු කල යුතුද? රජය මොවුනට විරුද්ධව නිසි ක්‍රියා මාර්ග ගනු ලබත් ද? රජයට එය සිහිපත් කර දීමට ඒ සඳහා විසඳුමක් ලබා දීමට විරුද්ධ පක්ෂය සමත් වුවාද? එසේ නොමැති නම් අප කල යුත්තේ කුමක් ද?
පාර්ලිමේන්තුවේ 225න් කීයෙන් කීදෙනෙක් පොදු ජනතාව ගේ ගැටළු නිරාකරණය කළෝද?
විධායක ජනාධිපති වරයා මේ සඳහා ගත් පිළියම් මොනවාද? මේවාට උත්තර නැත. කිසිවෙකුට උත්තර දිය නොහැකිය. දේශපාලන පිළිතුරු ප්‍රමාණවත් නොවේ. කොමිසන් පත්කිරීම අතීසාරයට අමුඩ ගැසුවා වැනිය.
කල හැකි කිසිවක් නොමැති ජනතාව අද සාමකාමී අරගලයට අවතීර්ණ වී ඇත.
ගෝටා ගෝ හෝම් කියන්නේ, මේ ජනාධිපති ක්‍රමය වෙනස් කිරීමට පටන් ගත යුතු තැනය.
225ම එපා කියන්නේ කිසිවෙක් පොදු ජනතාවගේ අයිතීන් සුරක්ෂිත කිරීමට අසමත් වූ නිසාය.
ක්‍රමය පෙරලමු කියන්නේ පොඩි එකාගේ සිට ලොකු එකා දක්වාත් ලොකු එකාගේ සිට පොඩි එකා දක්වාත් සියලු නිල තල හොබවන රාජ්‍ය තන්ත්‍රය වෙනස් කිරීමටය.
එසේ නම් විසඳුම සොයා ගත යුතුව ඇත්තේ අරගලයෙන් මිස වෙන කිසිම අයුරකින් නොවෙන බව අප සියලු දෙනාම අවභෝධ කර ගත යුතුව ඇත.

‘Then they came for me, and there was no one left to speak out for me.’

In the law of our country, we are not talking about the supremacy of law but the independence, application and practice of law; for us to experience and comprehend the true meaning of “justice for all”, we have lessons to learn for another 30 years. It is necessary, not because this writer is a pessimist, but because we must learn and unlearn many things we have failed to understand for the last 74 years. This is the stark reality of our situation. Throughout this 74-year history, how many innocent people have been jailed? How many activists, who fought for the rights of the people, were imprisoned, detained or disappeared? How many child abusers, sex offenders, murderers, criminals, large-scale drug dealers, and large-scale financial frauds have been allowed to serve justice or been acquitted? This is apparent in how the Chief Justice, Supreme Court Judges, District Judges, Lawyers, legal community and even the lowest level office worker behave. The entire legal system of the country is rotten.

Now a new development of the struggle has risen. The legal community, including the Ceylon Lawyers Association, the lifelong members of the country’s law and justice system, have taken to the streets. The Lawyers have joined as participants, supporters and saviours of the new youth struggle as if they had suddenly woken up from a long slumber. Whatever their purpose or need, the action is commendable. The “I” should disappear in this public disaster, and the “we” should emerge and shine as one. However, what the legal community, including the Lawyers’ Association of Sri Lanka, who have entered the field of struggle, should do is change our experience of our country’s law. They should work together to ensure that the practice of law in our country “is equal to all”.

It is the duty of the lawyer’s community, including the Lawyers Association of Sri Lanka today, to make the “independence and practice of law” a tool that carries the confidence of all the country’s people.

நம் நாட்டின் சட்டத்தில், நாம் சட்டத்தின் மேலாதிக்கத்தைப் பற்றி பேசவில்லை, ஆனால் சட்டத்தின் சுதந்திரம், பயன்பாடு மற்றும் நடைமுறை; “அனைவருக்கும் நீதி” என்பதன் உண்மையான அர்த்தத்தை அனுபவித்து புரிந்து கொள்ள, இன்னும் 30 ஆண்டுகளுக்கு நாம் கற்றுக்கொள்ள வேண்டிய பாடங்கள் உள்ளன. இது அவசியமானது. இந்த எழுத்தாளர் ஒரு அவநம்பிக்கையாளர் என்பதால் அல்ல, ஆனால் கடந்த 74 ஆண்டுகளாக நாம் தவறாக புரிந்துகொண்ட, புரிந்துகொள்ளத் தவறிய பல விஷயங்களைக் திருத்திக்கொள்ள மற்றும் கற்றுக்கொள்ள வேண்டும். இதுவே நமது நிலைமையின் அப்பட்டமான உண்மை.

இந்த 74 வருட வரலாற்றில் எத்தனை அப்பாவிகள் சிறையில் அடைக்கப்பட்டிருக்கிறார்கள்? மக்களின் உரிமைகளுக்காகப் போராடிய எத்தனை ஆர்வலர்கள் சிறையில் அடைக்கப்பட்டார்கள், தடுத்து வைக்கப்பட்டார்கள் அல்லது காணாமல் போனார்கள்? எத்தனை குழந்தைகளை துஷ்பிரயோகம் செய்பவர்கள், பாலியல் குற்றவாளிகள், கொலைகாரர்கள், குற்றவாளிகள், பெரிய அளவிலான போதைப்பொருள் வியாபாரிகள் மற்றும் பெரிய அளவிலான நிதி மோசடி செய்தவர்கள் நீதி வழங்க அனுமதிக்கப்பட்டுள்ளனர் அல்லது விடுவிக்கப்பட்டுள்ளனர்? தலைமை நீதிபதி, சுப்ரீம் கோர்ட் நீதிபதிகள், மாவட்ட நீதிபதிகள், வழக்கறிஞர்கள், வழக்கறிஞர்கள் சமூகம் மற்றும் கீழ்மட்ட அலுவலக பணியாளர்கள் கூட எப்படி நடந்து கொள்கிறார்கள் என்பதில் இது தெரிகிறது. நாட்டின் ஒட்டுமொத்த சட்ட அமைப்பும் அழுகி விட்டது.

இப்போது போராட்டத்தின் புதிய வளர்ச்சி எழுந்துள்ளது. இலங்கை சட்டத்தரணிகள் சங்கம் உள்ளிட்ட சட்டத்தரணிகள் சமூகம், நாட்டின் சட்டம் மற்றும் நீதி அமைப்பில் வாழ்நாள் முழுவதும் அங்கம் வகிக்கும் உறுப்பினர்கள் வீதியில் இறங்கியுள்ளனர். சட்டத்தரணிகள் நீண்ட உறக்கத்தில் இருந்து திடீரென விழித்துக்கொண்டது போல் புதிய இளைஞர்களின் போராட்டத்தின் பங்கேற்பாளர்களாகவும், ஆதரவாளர்களாகவும், மீட்பர்களாகவும் இணைந்துள்ளனர். அவர்களின் நோக்கம் அல்லது தேவை எதுவாக இருந்தாலும், நடவடிக்கை பாராட்டுக்குரியது. இந்த பொதுப் பேரிடரில் “நான்” மறைந்து, “நாம்” ஒன்று தோன்றி பிரகாசிக்க வேண்டும். எனினும் போராட்டக் களத்தில் இறங்கிய இலங்கை சட்டத்தரணிகள் சங்கம் உள்ளிட்ட சட்டத்தரணிகள் சமூகம் செய்ய வேண்டியது எமது நாட்டின் சட்ட அனுபவத்தை மாற்றியமைப்பதாகும். நம் நாட்டில் சட்ட நடைமுறை “அனைவருக்கும் சமம்” என்பதை உறுதிப்படுத்த அவர்கள் ஒன்றிணைந்து செயல்பட வேண்டும்.
“சுதந்திரம் மற்றும் சட்ட நடைமுறையை” அனைத்து நாட்டு மக்களின் நம்பிக்கையையும் சுமந்து செல்லும் ஒரு கருவியாக மாற்றுவது இன்று இலங்கை சட்டத்தரணிகள் சங்கம் உட்பட சட்டத்தரணி சமூகத்தின் கடமையாகும்.
